The landmark victory in the University of Michigan case Grutter v Bollinger not only reaffirmed the value of affirmative action, it also broadened its scope in many significant ways. Yet, while supporters of affirmative action have reason to be hopeful, the Grutter decision remains vulnerable to a host of counter-initiatives that seek to limit, if not completely eliminate, affirmative action in higher education and beyond .
As we celebrate the 50th anniversary of Brown v. Board of Education, it appears that advocates of racial equity may have to accomplish infinitely more in half the time, given Justice O’Connor’s intimation that reasonable equity in educational opportunities will be realized within 25 years. This will require an enormous collaborative effort, beginning now, among the many stakeholders who defended affirmative action in Grutter.
